OPINION

On order of the Court, the motion for leave to file an amicus curiae brief in support of the application for leave to appeal is considered, and it is GRANTED.

The application for leave to appeal is also considered, and it is DENIED, because we are not persuaded that the question presented should be reviewed by this Court. The denial is without prejudice to the plaintiff's right to proceed on the alternative theory that the house is forfeitable because it is "traceable to an exchange for a controlled substance". MCL 333.7521(f); MSA 14.15(7521) (f).

Brickley and Boyle, JJ., would grant leave to appeal.
