The Defendant-Property is the seized asset. This might be described by its year/make/model/VIN# or cash, which would be described as "EIGHTEEN THOUSAND DOLLARD US CURRENCY." The description of the property should appear on your forfeiture paperwork.

You are the Claimant. There may be more than one claimant. Each claimant who wants to protect and preserve their right to contest the forfeiture should complete their own Claim of Interest.

The police department that took your property is the seizing agency. The seizing agency should be listed on your forfeiture paperwork. It is not the tow yard where the vehicle is being stored.

The case number remains blank until a civil action is filed by the prosecutor's office. Once you file your Claim of Interest, the prosecutor's office is under a duty to institute forfeiture proceedings promptly.

YOU MUST SERVE THE CLAIM ON INTEREST! If it is not served, it is a worthless piece of paper that no one knows about except you. You should serve the police department by personal service, fax, and/or certified mail. You should also serve a copy on the Wayne County Prosecutor's Office Forfeiture Division. Keep a copy of your Claim of Interest and your poof of service.
